CJI DY Chandrachud Will Decide On An Urgent Listing To Take Into Account Muslim Students’ Requests To Take Exams At Government Colleges In The Hijab Case

On February 22, Chief Justice of India DY Chandrachud announced that he would decide whether to list the Hijab case from Karnataka so that the court could take into account the Muslim girls’ request for a temporary injunction so they could take examinations in government colleges.

The issue was brought up before the CJI by attorney Shadan Farast, who requested an urgent listing and stated that the exams would start on March 9.

On January 23, after Senior Advocate Meenakshi Arora raised the urgency of the exams that are conducted in government institutions, the CJI agreed to consider the request for an urgent listing.

Numerous Muslim students were forced to transfer to private institutions after the Karnataka government outlawed the hijab in government pre-university colleges. However, government institutions are where the exams are given. The petitioners ask for authorization to take exams against this backdrop.

The Karnataka High Court upheld the state government’s prohibition on Muslim females wearing religious headscarves in government colleges in March 2022. A two-judge Supreme Court panel issued a split decision in the appeals in October 2022, with Justice Hemant Gupta upholding the hijab prohibition and Justice Sudhanshu Dhulia disapproving of it.
