BJP’s Suvendu Adhikari Withdraws A Petition To The Supreme Court ,Arguing That MLA Mukul Roy Should Be Disqualified
Suvendu Adhikari, the leader of the opposition in the West Bengal Legislative Assembly, withdrew his appeal to the Supreme Court on February 24, contesting the speaker’s decision to not expel MLA Mukul Roy.
Roy was declared a Bharatiya Janta Party (BJP) MLA by speaker Biman Banerjee on June 8, 2022, despite the fact that Adhikari and the BJP claim that he switched parties to the Trinamool Congress (TMC) after the results of the 2021 elections were revealed.
A bench of Justices Dinesh Maheshwari and Sanjay Kumar expressed their concerns about Adhikari’s decision to circumvent the Calcutta High Court when their choice to hear Adhikari’s appeal against the speaker’s decision came up for hearing.
The court also observed that Adhikari had previously contacted the supreme court and was instructed to move to the High Court.
Senior Advocate Gopal Sankaranarayanan, appearing for Adhikari, informed the Court that the plea was submitted since the case in which the apex court had previously ordered the High Court to hear the matter has been pending before the Supreme Court.
The Court did advise moving the petition before the Calcutta High Court, though.
Then, senior attorney CS Vaidyanathan, who was representing Adhikari, decided to retract the plea.
Attorney Surjendu Sankar Das submitted the plea on behalf of the client.
