The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 is a crucial legal framework that applies to all National Sports Federations (NSFs), treating them as any other entity under the Act. As per the provisions of the Act, NSFs are required to take prompt action in cases of reported sexual harassment. The Ministry of Youth Affairs & Sports has been actively issuing instructions to NSFs on preventing sexual harassment in sports.
Over the last three years, complaints of sexual harassment have been reported by four NSFs, highlighting the pressing need for vigilance and effective implementation of preventive measures. In August 2010, the Ministry issued comprehensive instructions to all NSFs to comply with the guidelines laid down by the Supreme Court in the landmark case of Vishakha and Others vs. State of Rajasthan and Others. After the enactment of the POSH Act in 2013, its provisions have become applicable to all NSFs, mandating them to act in accordance with the legal framework in cases of reported harassment.
Recognizing the importance of maintaining a safe and positive environment in sports, the Ministry has taken proactive steps to sensitize the Indian Olympic Association (IOA) and all NSFs about the significance of the POSH Act. In January 2023, the Ministry reiterated its call for the IOA and NSFs to review their structures and policies to align with the Act and make necessary changes or modifications. Additionally, the IOA and NSFs have been urged to raise awareness among their office bearers, coaches, administrative staff, and players on the prevention of sexual harassment in the world of sports.
The Sports Authority of India (SAI), an autonomous body under the Ministry’s administrative control, has played a vital role in ensuring a safe and respectful environment in sports. SAI has implemented specific guidelines to foster a culture of appropriate behaviour and moral conduct in line with sportsmanship values. A crucial aspect of this effort is the establishment of a 24*7 helpline for players to provide them with support and assistance whenever needed.
To further strengthen safety measures, SAI has proposed a set of proactive measures to NSFs:
1. Mandatory inclusion of a women’s coach in the contingent accompanying female athletes during domestic and international camps and competitions.
2. Appointment of Compliance Officers (both male and female) in all National Coaching Camps and Foreign Exposures. These officers will be responsible for ensuring adherence to prevention of sexual harassment guidelines and reporting any violations promptly to the relevant authorities.
3. Pre-camp sensitization modules for all athletes, coaches, and support staff before the commencement of any National Coaching Camp and Foreign Exposure.
4. Encouraging an increase in the number of women coaches and support staff in National Coaching Camps by respective NSFs.
Minister of Sports & Youth Affairs, Shri Anurag Singh Thakur, emphasized the importance of these initiatives in the Rajya Sabha today. By implementing such measures, the government aims to empower women in sports and ensure their safety and dignity.
