“Fair criticism”: No contempt case on three critics of Supreme Court on Nupur Sharma remark.

Attorney General KK Venugopal has said that there will be no contempt of court against a former judge and two lawyers who had criticized the supreme courts observation on Nupur Sharma for her comment against profit Mohammed and Islam he even justify the criticism it was fair and reasonable.

CR Jaya Sukin, a lawyer filed a contempt case against former Delhi high court judge SN Dhingra, former additional general Aman Lekhi, and senior advocate K Rama Kumar. According to law consent from the Attorney General is mandatory. The Attorney General refused saying ‘The Supreme Court is the larger number of judgement that has held that fair and reasonable criticism of judicial proceedings would not constitute contempt of court. The comment by these three men is that we are not abusive’, he added.

At the centre of the controversy there is an observation by a two-judge bench of Supreme Court including that Nupur Sharma ‘is single handedly responsible for everything that is happening in the country’ after her statement on Prophet Muhammad and Islam. The statement passed by the supreme court was criticized by many former judges including former army officers.

Jaya Sukhin in his related to Attorney General wrote about a former judge and two lawyers and say that these three men insulted ‘the supreme court and not only cast aspersions on the integrity of the top court but also attended to sinalize the Nations highest judiciary’.

On this the Attorney General replied, ‘I am not satisfied that the criticism made by the three persons named in your letter is with malice or is an attempt to impaired the administration of justice, or that it was a deliberate and motivated attempt to bring down the image of the judiciary’.

Before that Nupur Sharma went to the supreme court demanding that all the registered FIR against her across the country should be transferred to Delhi. The court on July 1 refused her request and made some scattering comments. The judges said Nupur Sharma’s “loose tongue” had “set the entire country on fire” and her comments were either for cheap publicity, political agenda activity.

On This remark of the Supreme Court of India, the 15 ex judges, 77 bureaucrats and 25 retired officers of the armed forces wrote an open letter to chief justice of India CV Ramana, criticizing this observation.
