Supreme Court: Same-Sex Marriage Issue Is Of “Seminal Importance”
The Supreme Court announced on March13 that a five-judge Constitution panel will hear closing arguments on April 18 regarding the legal recognition of same-sex marriages in India. The Supreme Court stated that any ruling on the matter would have a significant impact on society and referred to it as a matter of seminal importance.
The Supreme Court website and YouTube will both broadcast the hearing live.
According to Article 145 (3), any case containing a significant legal issue pertaining to the interpretation of the constitution must be decided by at least five judges.
At least four gay couples have recently asked the court to recognize same-sex unions, contending that the LGBTQ community should be granted the same freedom to marry whomever they choose.
The Center has argued that same-sex marriage is incompatible with the concept of the “Indian family unit”, which it says consists of a husband, wife, and children, which necessarily requires a biological male as “husband”. the biological female as “wife” and the children born of the union between the two – raised by the biological male as the father and the biological female as the mother.
The government’s solicitor general, Tushar Mehta, claimed that legal issues would arise if homosexual marriages were recognized.
According to the Center, the decriminalization of homosexual sex should not be interpreted as the right to wed. The government’s attorney added that the topic had a statutory purpose.
Abhishek Manu Singhvi, who is the petitioners’ attorney, argued that no one’s ability to marry should be restricted because of their sexual preference.
