In advance of Diwali, the SC rejects a complete ban on firecrackers; favors a balanced strategy

A balanced approach has been preferred by the Supreme Court, which has rejected a total ban on firecrackers prior to Diwali. A bench of Justices MM Sundresh and PB Varale ruled against both a complete ban and unlimited cracker bursting, stating that it will allow the usage of some firecrackers during Diwali but set time limits.
The supreme court emphasized that religious beliefs and the negative consequences of air pollution must be balanced. It stated that allowing firecrackers all day will negatively impact the environment and vulnerable groups, such as children, the elderly, and the sick, while a total ban could harm the feelings of those celebrating Diwali.
A long-standing case involving firecracker bans in Delhi-NCR and other northern states during a time of extreme air pollution was being heard by the Supreme Court. The bench also stated that, under certain restrictions, it is likely to approve a proposal to allow joint firecrackers, or “larri.”
Additional Solicitor General Aishwarya Bhati requested an extension until October 15 to record the Central Pollution Control Board’s report on barium-based firecrackers, citing the lack of outside testing. The bench granted the requested time and stated that it would review the report before determining whether types of firecrackers are acceptable.
