MBBS Physician Found Unfit To Enroll In A PG Medical Program

After getting a report from AIIMS stating that Dr. Laxmi will be able to carry out the duties expected of a Post Graduate Specialist Doctor, the Delhi High Court granted permission for the Divyang female doctor to pursue a Post Graduation Medical Course.

An expert committee has been established, and they have concluded that the petitioner would be able to perform the functions anticipated from a post-graduate specialist doctor, according to the ruling issued by Justice Sanjeev Narula’s bench on September 14. Due to this, the petitioner is allowed to take part in counseling for the post-graduate level medical course because she satisfies the criterion.

Dr. Laxmi, a divyang doctor, recently petitioned the Delhi High Court through attorney Gaurav Kumar Bansal, challenging the medical board of VMMC Safdarjung college’s Disability Certificate, which declared her ineligible to pursue a career in medicine.

The Bench has also sent notices to the Union Social Justice Ministry, the Union Health Ministry, the National Medical Commission, and others asking for their comments on the matter of the creation of a high-level committee to review the National Medical Council’s (NMC) guidelines for teaching medicine to divyang students while taking into account international best practices in the area.

The National Medical Commission (NMC), which is now representing the Divyang Doctor Gaurav Kumar Bansal, argued that the NMC’s expert committee report to the Ministry of Health and Family Welfare in 2017 stressed the need for routine re-evaluation of the rules governing medical education for Divyang students.

Bansal also noted that the Board of Governors later discussed the issue of the challenges faced by Divyang MBBS students in receiving admission to post-graduate medical education in its thirteenth meeting and as a result decided that it is necessary to form the committee that should investigate the eligibility for the particular PG course that Divyansh doctors could pursue.

In order to ensure there is no discrimination, it is crucial to include doctors with disabilities in such committees, according to Gaurav Kumar Bansal, the attorney representing Divyang Doctor, who stated before the court that Divyang Students frequently complain about issues of bias and discrimination against them.

Instead of relying merely on the proportion of disability of such students, Bansal contended before the Court, NMC must consider the Functional Competency of Divyang Students in Cases of Disability Assessment of Divyang Students and the same should be assessed by Provision of Assistive Devices.

The petitioner had claimed that VMMC Safdarjung College did not permit her to use a caliper during the examination and that this led to an inaccurate evaluation of her functional disability.
