Apple challenges $587 million EU antitrust penalty in court.

Apple has launched a challenge against EU regulators in Europe’s second highest court on Monday after being fined 500 million euros ($587 million) earlier this year for violating significant rules intended to limit the influence of Big Tech.

In an April ruling, the European Commission stated that the technical and commercial constraints imposed by the iPhone manufacturer, which hinder app developers from directing users to more affordable options outside the App Store, violated the Digital Markets Act. Apple, having previously announced its intention to pursue legal action, submitted its lawsuit on Monday, the last day to file.

“Today we filed our appeal because we believe the European Commission’s decision – and their unprecedented fine – go far beyond what the law requires,” the company said in a statement.

“As our appeal will show, the EC is mandating how we run our store and forcing business terms which are confusing for developers and bad for users. We implemented this to avoid punitive daily fines and will share the facts with the court.”

Last month, Apple revised its App Store regulations to align with the EU mandate to eliminate its technical and commercial restrictions on app developers to prevent daily penalties of 5% of its average daily global revenue, roughly 50 million euros each day. The EU competition authority is gathering opinions from app developers before determining whether to approve the modifications or request further changes.
