20 Trinamool Rebel MPs received a notice from the Supreme Court. Why the Speaker Didn’t Receive One

Twenty dissident Trinamool MPs who left the party and merged with the obscure NCPI to join the NDA were given notice by the Supreme Court on Tuesday. Abhishek Banerjee, a member of the Lok Sabha and general secretary of the Trinamool Congress, petitioned for the notice. The TMC leader has petitioned the Supreme Court to have Speaker Om Birla rule quickly on the party’s requests to disqualify the 20 dissident MPs.

After hearing the petition, a bench made up of Chief Justice Surya Kant, Justices Joymalya Bagchi, and Vipul M. Pancholi sent out notifications. Solicitor General Tushar Mehta, who represented the Speaker in court, requested that the court give notice to the Speaker, but the court had previously stated that it would. Mehta declared that he will represent the Speaker. He continued by saying that he was instructed to state that the Speaker had sent out notices regarding the petitions for disqualification.

In response to the SG’s argument, Justice Bagchi stated, “It is not a question of issuing notices; it is a question of concluding the proceedings within a time frame.” In his plea, Banerjee has contested the purported delay in reaching a decision regarding the MPs’ disqualification.

In response to the court proceedings, Kalyan Banerjee, who represented Abhishek Banerjee, stated that the court will soon provide a date and that it was a significant victory for the Trinamool. After 20 of the TMC’s Lok Sabha MPs declared that they had joined or merged with the National Citizens Party of India (NCPI), a political group centred in Tripura, and sought independent registration in the House, there was a mutiny within the party.

Since then, the dissident MPs have attended NDA meetings and been regarded as an NCPI group in Parliament. The TMC has insisted that the MPs were elected using its emblem and that their choice to join a different political organization equates to willingly renouncing party membership, which would result in disqualification under the anti-defection law.

However, the rebel group has insisted that its action is a legitimate merger. In addition to the 20 MPs who are the targets of disqualification proceedings, the petition includes the Secretary General and the Speaker of the Lok Sabha as respondents.
