The Competition Commission of India (CCI) has announced its plans to conduct a comprehensive Market Study on Artificial Intelligence (AI) and Competition, aiming to delve into the transformative potential of AI while identifying associated competition concerns. This initiative underscores the CCI’s commitment to understanding the evolving dynamics of AI ecosystems and their implications for competition, efficiency, and innovation across various industries.

The Market Study seeks to achieve several key objectives:

  1. Gain insights into the AI systems and their corresponding markets/ecosystems, including key stakeholders, value chains, market structures, and competitive parameters.
  2. Identify emerging and potential competition issues within these AI markets/ecosystems.
  3. Explore the scope and nature of AI applications/use cases, assessing associated opportunities, risks, and competitive implications.
  4. Examine the existing regulatory and legal frameworks governing AI systems and applications in India and other major jurisdictions.
  5. Engage with relevant stakeholders to obtain a comprehensive understanding of the intersection between AI and competition.
  6. Analyze trends and patterns in AI development and ascertain enforcement and advocacy priorities of the Commission in this domain.

The CCI, established under the Competition Act, 2002, is entrusted with the task of promoting and sustaining competition, protecting consumer interests, and ensuring the freedom of trade in Indian markets. Section 18 of the Act mandates the CCI to eliminate practices that adversely affect competition, fostering an environment conducive to fair and competitive market practices.

To fulfill its mandate under the Act, the CCI is seeking proposals from qualified agencies or institutions to undertake the Market Study on AI and Competition. Interested parties are invited to submit their proposals by June 3, 2024, to be considered for engagement in this important research endeavor.

The Market Study aims to bridge the gap in understanding the complex interplay between AI advancements and competition dynamics. By exploring AI ecosystems comprehensively, the study intends to shed light on the transformative potential of AI while identifying regulatory challenges and areas for intervention to safeguard competition and promote innovation.
