Supreme Court Declines Bengal’s Plea to Stay NIA Probe into Beldanga Violence

The Supreme Court of India has refused to grant relief to the West Bengal government in its attempt to halt the probe by the National Investigation Agency into the recent violence in Beldanga, Murshidabad district. The decision allows the central agency to continue its investigation into the incident, which had triggered significant unrest earlier this year.

A bench comprising Justice Surya Kant and Justice Joymalya Bagchi observed that there was no reason to interfere with the order passed by the Calcutta High Court. The High Court had earlier declined to stay the NIA probe, terming its approach as balanced and appropriate in the circumstances. Upholding that view, the apex court indicated that the matter did not warrant intervention at this stage.

The case relates to violent clashes reported in January 2026 in Beldanga, where protests spiralled into large-scale disturbances. Incidents of arson, vandalism, and damage to public and private property were reported, raising concerns over law and order in the region. Authorities also flagged the possible use of inflammable materials by certain individuals, intensifying the seriousness of the allegations.

The legal battle began when the Calcutta High Court, while hearing petitions related to the violence, asked the NIA to consider whether it should exercise its suo motu powers under the NIA Act. The court also suggested examining the applicability of stringent provisions under the Unlawful Activities (Prevention) Act. Acting on these directions, the Centre subsequently handed over the case to the NIA for further investigation.

Challenging this move, the West Bengal government approached the Supreme Court, arguing against the central agency’s involvement and seeking a stay on the probe. However, the apex court maintained that the High Court remains the appropriate forum to assess the legality and necessity of the NIA’s intervention, particularly after examining the evidence gathered during the investigation.

The ruling underscores the ongoing tussle between the state government and the Centre over jurisdiction in sensitive criminal cases. With the Supreme Court declining to pause the proceedings, the NIA is set to continue its probe into the Beldanga violence, even as the Calcutta High Court continues to hear related matters.
