Supreme Court of India rebukes Haryana Police, magistrate over handling of minor rape case

The Supreme Court of India has sharply criticised the conduct of the Haryana Police and a magistrate in connection with the handling of a minor rape case, describing their approach as “insensitive” and unacceptable. The apex court expressed deep concern over serious procedural lapses and failure to follow mandatory safeguards laid down under laws designed to protect children, including the Protection of Children from Sexual Offences Act.
During the hearing, the bench questioned how authorities could neglect essential protocols meant to ensure the safety, dignity, and psychological well-being of the minor victim. It noted that such cases demand a high level of sensitivity, urgency, and strict adherence to legal procedures. The court observed that any deviation from established guidelines not only weakens the legal process but also exacerbates the trauma experienced by the survivor.
The judges emphasised that officials entrusted with handling cases involving minors must act with responsibility and compassion. They pointed out that lapses by both the police and the magistrate reflected a concerning disregard for victim-centric justice. The court underlined that legal provisions like the POCSO Act are specifically designed to ensure that child victims are treated with care and that their statements are recorded and handled in a manner that minimises distress.
Expressing dissatisfaction, the court made it clear that such negligence cannot be tolerated and called for accountability. It stressed that institutions involved in the criminal justice system must work in coordination and uphold the highest standards of conduct, particularly in sensitive cases. The observations highlight the judiciary’s firm stance on enforcing proper procedures and ensuring that victims, especially minors, receive protection and justice. The ruling serves as a reminder to law enforcement and judicial officers to strictly follow the law and maintain a humane approach while dealing with vulnerable individuals.
