Delhi High Court Refuses Interim Relief to Delhi Gymkhana Club in Eviction Row

The Delhi High Court on Tuesday declined to grant interim protection to the historic Delhi Gymkhana Club in its challenge against the Centre’s order directing the club to vacate its 27.3-acre premises in Lutyens’ Delhi by June 5. However, the court recorded the Union government’s assurance that no forcible action would be taken without following due legal procedure.
The matter was heard by Justice Avneesh Jhingan after the club and several of its members approached the court against the eviction notice issued by the Centre. Appearing for the Union government, Solicitor General Tushar Mehta stated that authorities were only seeking a peaceful transfer of the property and would not carry out any sudden takeover or police action.
The Centre has argued that the land is required for public purposes, including projects linked to defence and security infrastructure. According to government submissions, provisions within the lease agreement permit authorities to reclaim the land whenever it is needed in national or public interest. The Land and Development Office under the Ministry of Housing and Urban Affairs had earlier directed the club to hand over possession of the premises.
Senior advocate Abhishek Manu Singhvi, representing the club, argued before the court that the government’s communication amounted to a direct eviction order rather than a procedural notice. He also highlighted the possible impact on thousands of members, staff and sporting activities associated with the institution.
Established in 1913 during the British era, the Delhi Gymkhana Club remains one of the capital’s oldest and most prestigious social institutions, frequented by diplomats, bureaucrats, military officials and prominent public figures. The High Court has now issued summons in the matter and granted time to the Centre to file its detailed response.
