New Regulations For The Protection Of Temporary Foreign Employees In Canada

Employment and Social Development Canada (ESDC) and Immigration, Refugees and Citizenship Canada (IRCC) have jointly announced the 13 changes to the Immigration and Refugee Protection Regulations regarding Temporary Foreign Workers, according to a report by CIC News (TFWs). The 13 amendments are all intended to improve the TFWP and increase TFW protections.

Employers can fill labor shortages by hiring globally under the TFWP program. TFWs are granted the same rights as citizens or lawful permanent residents of Canada.

Benefits of the new law or amendment: 

These laws will defend TFWs in the nation against mistreatment and abuse. Additionally, according to ESDC, the rules would require businesses to remind TFWs of their legal rights in the nation.

According to ESDC, it will also forbid employers from retaliating against employees, such as those who file complaints. Additionally, it will make it illegal for businesses to charge workers recruitment fees and hold them responsible for the acts of recruiters in this area.

In accordance with the law, companies must also provide their staff with private health insurance so that they have access to healthcare services.

According to ESDC, these modifications also aim to discourage dishonest individuals from taking part in the TFWP. The regulations will enhance the TFWP’s capacity to inspect workplaces, enforce the rules, and impose suitable sanctions on those who choose not to abide by the rules, in addition to the employees.

In addition to the restrictions outlined above, ESDC has established other measures like mandatory training, a system that allows employees to report any instances of program abuse or misuse, raising employer knowledge, and extending coordination with consulates. LMIAs would be suspended if a company didn’t abide by the new rules.

An employer must submit a Labour Market Impact Assessments (LMIA) paperwork to the ESDC before hiring any overseas workers. The employer can only hire Canadian or permanent residents without this.
